These Terms of Use ("Terms") govern your access to and use of the ChatDataMask browser extension and the chatdatamask.com website (together, the "Service"), operated by Andrii Kozak, a Poland-based individual owner and tax resident (the "Publisher", "we", "us"). By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not install or use the Service.
You must be at least 16 years old, or the age of digital consent in your jurisdiction if higher, to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal authority to accept these Terms on your own behalf or, if applicable, on behalf of an organization.
ChatDataMask is a Chrome extension that helps detect and mask personally identifiable information (PII) and other sensitive text locally in your browser before you paste it into third-party AI chat platforms, and restores the original values afterward. The Service is offered in a free tier ("Free Plan") and a paid tier ("Pro Plan") with expanded detection categories, purchased on a one-time, per-month basis as described on the Service's pricing page from time to time.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for your own personal or internal business purposes. You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent such restriction is prohibited by applicable law; (b) resell, sublicense, rent, or distribute the Service or any license key without our prior written consent; (c) use the Service for any unlawful purpose or in a manner that violates the rights of any third party; or (d) circumvent or attempt to circumvent any license validation or Pro-tier access control mechanism.
The Service is provided on an "as-is" and "as-available" basis. While it uses local validation patterns (such as 'libphonenumber-js' and checksum-based algorithms) to detect and mask sensitive data, the Publisher does not guarantee complete or error-free detection, due to the inherently unpredictable nature of free-form natural language. You specifically acknowledge the following technical limitations:
The Service is a technical tool that can help reduce the risk of sensitive data being included in text sent to third-party AI platforms. It is not a certified compliance product, and using it does not by itself guarantee compliance with the GDPR, the EU AI Act, CCPA, HIPAA, or any other law or regulation. You remain solely responsible for determining whether your use of the Service, and of any third-party AI platform, satisfies your organization's legal and regulatory obligations, and for obtaining independent legal advice where needed.
The Service operates purely as a helper utility to reduce data leak risk. You bear sole, final, and exclusive responsibility for reviewing and verifying both the masked text and the restored text before sending any data to, or acting on any output received from, third-party Artificial Intelligence platforms (including but not limited to OpenAI ChatGPT, Anthropic Claude, Google Gemini, and Microsoft Copilot).
The Service integrates with the following third-party providers to operate the Pro Plan: Creem (payment processing), Resend (transactional email delivery), and Cloudflare Workers (license token issuance). Your use of these providers as part of the Pro Plan is also subject to their respective terms and privacy policies. See our Privacy Policy for details on what data is shared with each.
Separately, if you explicitly enable optional usage statistics, ChatDataMask uses a Cloudflare Workers analytics relay and Google Analytics 4 to process limited product-usage statistics as described in our Privacy Policy.
ChatDataMask is an independent product and is not affiliated with, endorsed by, or sponsored by OpenAI, Anthropic, Google, or Microsoft. "ChatGPT", "Claude", "Gemini", and "Copilot" are trademarks of their respective owners, used here only to describe compatibility.
The Service, including its source code, design, and trademarks, is owned by the Publisher or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, without prejudice to any other rights or remedies available to us. Since the Pro Plan is a one-time monthly purchase rather than a recurring subscription, there is no ongoing subscription to cancel; you simply choose not to make a new purchase once your current access period ends.
To the maximum extent permitted by applicable law, in no event shall the Publisher be liable for any direct, indirect, incidental, special, or consequential damages, including without limitation regulatory fines (such as GDPR/RGPD/AVG fines), data breaches, business interruption, or non-compliance penalties, arising out of or related to your use of, misconfiguration of, or inability to use the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
You agree to indemnify and hold the Publisher harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party right, including any AI platform's terms of service.
These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Poland. If you are a consumer residing in another EU/EEA country, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence, which continue to apply alongside Polish law under applicable EU consumer-protection rules (Rome I Regulation, Art. 6). If you reside outside the EU/EEA (including in the United States), mandatory consumer-protection provisions of your local law may similarly continue to apply where they cannot be excluded by contract.
We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date above, and, where required by law, by additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Publisher regarding the Service.

IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
